Mr. Jason R. Needham, Millington, TN; Case Number D–37390
Violation: During, the Board’s routine NCEES Enforcement Exchange check revealed Mr. Needham was convicted of a felony, and is currently incarcerated serving an 18-month prison sentence and was assessed a fine of $172,393.00. Mr. Needham signed a Declaration consenting to the revocation of his license without any further procedural or substantive due process.
Act/Rule Violated: In accordance with Texas Occupations Code Chapter 53 and 22 TAC §139.43(a)(1), Mr. Needham’s incarceration for a felony requires the mandatory revocation of his P.E. license.

Mr. Jeffery L. Mattson, Sandy, UT; Case Number B–37377
Violation: Mr. Mattson offered and practiced engineering without being licensed by the Board by preparing and issuing an engineering memorandum, and his business entity offered and provided engineering services while the firm’s registration was expired and nonrenewable.
Act/Rule Violated: Tex. Occ. Code §§ 1001.004(c)(2)(A), 1001.301(a), and 1001.405(b)(1)–(2) and 22 TAC §137.77(a).
Resolution: Cease and Desist Order & Administrative Penalty of $1,800.00.

Star Structures, Inc. (F–9107), Raleigh, NC; Case Number B–37479
Violation: Star Structures, Inc. offered and provided consulting engineering services while its registration was expired. Star Structures, Inc. performed engineering services on seven Texas projects since its firm registration expired.
Act/Rule Violated: Tex. Occ. Code §§ 1001.405(b)(1) and (e)(1) and 22 TAC §§ 137.77(d) and (e).
Resolution: Administrative Penalty of $750.00.

John A. Rives Consulting Engineers (F-13555), Dallas, TX; Case Number B–37480
Violation: John A. Rives Consulting Engineers offered and provided consulting engineering services while its registration was expired. John A. Rives Consulting Engineers performed engineering services on nineteen Texas projects since its firm registration expired.
Act/Rule Violated: Tex. Occ. Code §§ 1001.405(b)(1) and (e)(1) and 22 TAC §§ 137.77(d) and (e).
Resolution: Administrative Penalty of $750.00.

Mr. Derek Patrick Cronin, P.E. #103354, Naples, FL; Case Number D–37412
Violation: In another jurisdiction, Mr. Cronin failed to complete the required 24 Professional Development Hours (PDH) of continuing education and falsely attested he completed the 24 PDH of continuing education. Mr. Cronin failed to properly and promptly notify the Board he had been disciplined by another jurisdiction's regulatory agency.
Act/Rule Violated: 22 TAC §137.5(c) and in accordance with 22 TAC §137.65(b), if Mr. Cronin’s conduct had occurred in Texas, his actions would have violated 22 TAC §§ 137.17(m) and (p)(2)–(p)(3), 137.51(c), and 137.63(a).
Resolution: Formal Reprimand.

Mr. Brian Llenes Agbulos, P.E. #96619, Fort Worth, TX; Case Number D–37452
Violation: In another jurisdiction, Mr. Agbulos offered and practiced engineering without being licensed by that jurisdiction's regulatory agency. Mr. Agbulos failed to properly and promptly notify the Board he had been disciplined by another jurisdiction's regulatory agency.
Act/Rule Violated: 22 TAC §§ 137.5(c) and 137.65(a) and in accordance with 22 TAC §137.65(b), if Mr. Agbulos’s conduct had occurred in Texas, his actions would have violated Tex. Occ. Code §§ 1001.004(c)(2)(C) and 1001.301(a).
Resolution: Formal Reprimand.
